I ask if your server is running php safe mode .. in safe mode you will continue to get this error

Thry changing to the default SMF theme. If it woirks there, you are using the wrong theme before the change. Your themes need to be compatible with the SMF version, and TP enabled. Ordinary SMF themes dont work.

Make sure you chmodd your folder to 777, not just files.
