it is a theme called New Definition and free to download from downloads section.
if you want custom menu into the theme u have I would hit up DZ (here as memeber Bikken) for custom work.
you can experiment on your own by using a scriptblock and core code from http://www.dynamicdrive.com/dynamicindex1/
