Hi!
In my forum i've see that guest can rated some files in download area and this bug is present also in this site (see screenshot):

- rating downloads were allowed for guests.Fixed for TP v1.0 beta4

You are right, the fix was incomplete. I rewrote it, but the template solution will also work. :)
