Title: [SPLIT] Wilsy sale topic
Post by: G6Cad on October 06, 2007, 09:40:18 AM
Im not sure you are allowed to sell any thing else but the host space you have Wilsy, the software used (SMf TinyPortal, and also the mods used are under the FREE ware and cant be distrubuted or sold cause you dont really own it.

I will ask this in the team board and let it stay until Bloc or IchBin have had the time to look at this, im not sure this is legit  :-\

I think this is a sort of advertising that TP does not deem appropriate for the community, but Bloc or IchBin will know for sure..until then this thread should be locked IMO ..

Yes, i will lock this until we know more about how to handle it.
Also removed the links from the first page.
If Bloc or IchBin say it's ok, you can add them back Wilsy.

Ok, here is the answer to my question.
I asked Compuart on simplemachines.org about this, and his reply on the matter is this.

QuoteHi Carina,

Thanks for asking for our opinion about this issue.

I don't know the details about the selling of the site, but in most cases it's technically not redistribution. Basically if he'd tell the buyer the FTP login information of the site, it would be a shift of ownership, but not redistribution. If on the other hand, he would package the files of his site and offer the package as a file for the buyer to download it would be redistribution.

Hopefully that answers your question, let me know if you have any further questions.

Kind regards,
Hendrik Jan

So this topic will be unlocked, and Wilsy can place the urls back in his first post. And with that we hope the best for Wilsy and his site.

G6,
I congratulate you on your reversal but condemn you and the others because I not only think, I know it is wrong to behave like you initially did.
I have seen this before on this web site.
What are you all afraid of, the unknown?

(I know, the "group-think" reaction is if I feel that way I can always bug off and never come back to this web site....correct?).

If you read Compuart's reply you will see what G6's concern was. She did exactly the right thing, to leave the post as it was was not an option, the post could have been pulled from the board, but to lock it and seek clarification was the open and honest way to do it.

Ah? What are you talking about? There was a question of whether or not we could allow the sale of his site here, The post was locked until it was verified. End of question.

It amazes me that this d00d has an opinion that has nothing to do with him, all it's done is taken the topic further away from it's original point.

Yes, sometimes I am affraid that somethings might not be leagal and to protect us and tinyportal, i have to learn things just like any other member of this site. And thats exactly what i did here. Also i have had a private conversation with Wilsy on this matter, i explained to him why this topic was locked, and what i wanted to know before approval or denial. He was OK with it.

What did we learn from this then ?  Wilsy is ok with it, Im ok with it, Compuart is ok with it and the topic is unlocked and the answer i wanted to know have been posted for every one to see.
Things that are free to use have restrictions, these restrictions have a very thin line we all balance on. I balanced on it to day, and i wanted to know, thats the fact in this topic from my end. On Wilsys end, he want to sell his hosting account and the sofware in it, now we know that installed sofware is OK to sell with a hosting account, but not if it was just the hosting with packed SMF software to INSTALL.

Wilsy, if you want me to, i will remove the other posts in this thread so you have the topic clean, or you can start another if you like and i will just lock this as it have nothing to do with anyone except you and your topic headline. Not about wheter or not this topic was handled correct or not.

Yes, I agree you should lock it.
But you really should be consulting with a lawyer who is experienced with these types of public license software issues if you are in doubt.

Yes, pretty much.
A reply that I expected, but I lived through the "Love it or Leave" years back in the mid 1960s in the USA. I prefer to stay and try and try and change it for the better.

But you could always cancel my membership, right? Would I be the first?
Now lock it, out of sight-out of mind.
